1. Agreement to Terms

By accessing or using the Prestige Global Advisors website and services, you agree to be bound by these Terms of Service (“Terms”) and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Use License

4. Account Registration

To use certain features of our services, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Provide accurate, current, and complete information during registration
• Complete all required KYC (Know Your Customer) and AML (Anti-Money Laundering) verification
• Maintain and promptly update your account information
• Protect your login credentials and maintain account security

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

5. Fees and Compensation

• Administrative Fees: Account maintenance, wire transfers, statement fees
• Third-Party Costs: Custodian fees, regulatory fees, exchange fees

Detailed fee schedules are provided in your investment management agreement. Fees are subject to change with 30 days’ written notice.

6. Client Obligations

As a client, you agree to:

• Provide accurate and complete financial information
• Disclose any material changes to your financial situation
• Maintain minimum account balances as required
• Meet margin calls and funding obligations promptly
• Comply with all applicable laws and regulations
• Not engage in market manipulation, fraud, or abusive trading practices
• Review account statements and report discrepancies within 10 days

7. Trading Authority

Depending on your account type, Prestige Global Advisors may have:

• Discretionary Authority: Full discretion to trade on your behalf without prior approval
• Non-Discretionary Authority: Execute trades only with your specific authorization

The scope of authority is defined in your investment management agreement. You may revoke discretionary authority at any time with written notice.

8. Deposits and Withdrawals

Deposits: Minimum initial deposit requirements vary by account type. Funds must be from legitimate sources and in your name. We reserve the right to reject any deposit.

Withdrawals:Withdrawal requests are processed within 24–48 business hours. We reserve the right to:

• Require written authorization for withdrawals
• Delay withdrawals during market volatility or exceptional circumstances
• Reject withdrawals that violate account minimums or trading requirements
• Report suspicious transactions to regulatory authorities

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESTIGE GLOBAL ADVISORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, or investment opportunities
• Trading losses due to market conditions, system failures, or delays
• Errors, omissions, or interruptions in service
• Unauthorized access to your account or information
• Third-party actions (custodians, brokers, exchanges)

Our total liability shall not exceed the fees paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Prestige Global Advisors, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Your negligent or willful misconduct

11. Termination

We reserve the right to suspend or terminate your account and access to our services at our sole discretion, with or without cause, and with or without notice. Grounds for termination include:

• Violation of these Terms or our policies
• Fraudulent or illegal activities
• Failure to meet account requirements or margin calls
• Extended period of account inactivity
• Regulatory or legal requirements

Upon termination, you retain ownership of your assets. We will facilitate transfer to another institution subject to applicable procedures and fees.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with FINRA arbitration rules.

YOU HEREBY WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to the website. Material changes will be communicated via email or prominent notice. Continued use of our services after changes constitutes acceptance of the modified Terms.
